비로소, 뒤늦게, 그때서야 대응하는 에너지는 여전히 무책임하다. 1997년에 비로소 제정된 가정폭력방지법 제1조 목적조항은 다음과 같다. ‘이 법은 가정폭력을 예방하고 가정폭력의 피해자를 보호•지원함을 목적으로 한다.’ 이에 따른 ‘가정폭력범죄의 처벌 등에 관한 특례법“의 제1조 목적조항은 다음과 같다. “이 법은 가정폭력범죄로 파괴된 가정의 평화와 안정을 회복하고 건강한 가정을 가꾸며 피해자와 가족구성원의 인권을 보호함을 목적으로 한다.” 같은 문장과 내용이라도 배치와 순서에 따라 가해자는 미묘한 권력을 가진다. 1992년 12년간 자신을 성폭행한 아버지를 살해한 김보은의 선택은 결국 정당방위로 인정받지 못했다. 가정의 유지와 안정을 위시한 목적조항은, 여전히 피해자의 안전을 보장받을 수 없다는 의미로 읽을 수 있다.
‘김영오 성폭력 사건’의 전말을 텍스트와 이미지로 재구성한 나의 작업 ‘멍의 노래’는 사건에 개입된 경찰, 재판부, 무분별한 여론과 시선을 분리하고, 각각의 논지에서 파생된 문장을 지우고/드러내는 기록 행위이다. 흑백으로 인쇄된 과거의 기록을 다시 ‘기록’하는 시간 내내 3일에 한 번 꼴로 발생하는 여성 살해 사건을 접하며 나는 마치 불투명한 장막에 갇힌 무기력한 필경사가 된 것 같았다. 그러나 단단하게 연결된 폭력의 고리를 끊어내기 위하여 오늘도 싸우고 있는 목소리도 동시에 들렸다. 폭력을 암묵적으로 옹호하는 가부장적 사회를 조롱하고, 가해자를 향해 거침없이 쏟아내는 분노는 당시 대항하고 시위했던 수많은 목소리와 분명하게 연결되어 있었다.
바르게 고친 문장을 앞세우겠다. 현행의 제1조 목적조항은 ‘가정폭력범죄의 피해자와 가정구성원의 안전을 도모하고 인권을 보장함을 목적으로 한다’로 개정되어야 한다. 이는 19년 전 김보은의 정당방위를 주장했던 여성단체가 내세우는 오늘의 문장이자, 벽에 부딪혀 되돌아올지라도 다시 돌진해 찢고 부술 틈을 찾는 날카로운 우리의 목소리다. text by_봄로야

Energy that at last, belatedly, finally reacts is irresponsible. The 1st article of the law against domestic violence enacted in 1997 is as follows: ‘the law aims to prevent domestic violence and protect/assist the victim.’ The Special Act for the Punishment of Domestic Violence is thus as follows: ‘this act aims to restore peace and stability of a family destroyed by domestic violence, to make a healthy family, and to protect the human rights of the victim and family members.’ Although both have the same content, a perpetrator may have subtle power according to the arrangement and order of the phrase. Kim Bo-eun’s choice in 1992 to kill her father who raped her for 12 years could not be recognized as self-defense. The articles saying maintenance and stability of family still can be read as not to protect safety of the victim.

My work Song of Bruise is reconstruction of the story of ‘The Sexual Harassment Case of Kim Young-o,’ using text and image. It is an action of documenting to distinguish from the police, the court, and the public who intervened in the case, and to erase/reveal sentences derived from each one’s argument. When encountering femicide occurring once per three days in the process of re-‘documenting’ the past documents of black and white, I felt like a powerless scribe trapped in opaque veil. However, I also heard voices fighting today to cut out the strong chain of violence. Anger, which mocks the patriarchal society that implicitly defends violence and shouts out at attackers, was definitely connected to many voices who counteracted and protested at the time.

I will show a corrected sentence. The 1st article should be: ‘it aims to protect safety of the victims and family members and to ensure their human rights.’ This is today’s sentence, which is addressed by the women’s rights groups that claimed Kim Bo-eun’s self-defence 19 years ago, and our voice, which seeks a rupture to tear up and destroy again and again even when it is stuck.
